1     PRODUCTION
1.1.    Commission Process
The commission process starts when the Client contacts the Artist. The first step often involves a lot of back-and-forth between the Client and the Artist. The Client typically tells what they're looking for, shares either a reference image or written description of the subject of the requested artwork, and tells about any further requirements, such as the final usage of the artwork (profile picture, desktop background, print, etc.). The Artist, in return, gives a quote for the commission's final price, which the Client either approves or declines.
If the quote is approved, the Artist will produce a rough sketch and send it to the Client for approval. After approving the sketch, with or without requesting further changes to the sketch, the Artist sends an invoice for the payment, as previously discussed between the Artist and the Client.
The whole commission process consists of a lot of communication between the Artist and the Client; it includes Work-in-progress shots between different stages, input from the Client, and possible revisions as agreed between the Artist and the Client.
1.2.    Time Frames
Usually, one product takes from one (1) day to two (2) months to get completed. By commissioning the Artist, the Client agrees to let the Artist take their time working on the ordered product. The size of the product heavily affects the time taken to be completed.
1.3.    Queuing
The Artist will work on the commissions in the order they’ve been paid and confirmed.
1.4.    Deadlines
With a given reason, the client may request the artist to follow a specific deadline to complete the commissioned product. The minimum deadline is one week (7 days).
Orders with a deadline will have priority over orders without a given deadline.
The Artist may decline a commission with a short deadline if there is already a commission with a short deadline on the queue.


2     Copyrights And Usage
2.1.    The Artist’s Rights
The Artist retains full copyrights over the product on all of its production stages, including work in progress –previews sent to the Client.
The Artist may
Upload the final product on any online art gallery or portfolio unless requested otherwise by the Client
Use the product as a sample of sales and/or for self-promotion
Modify and then reuse any of the rejected sketches as a base for future products/projects
Reject any commission with (usually) or without given reason.
The Artist may not
Claim ownership of the IP used in the product
Reuse or resell the product in any personal or commercial project.
2.2.    The Client’s Rights
The Client retains copyrights over any Intellectual Property used in the product.
The Client may
Print the product for their personal use only
Share the product by re-uploading it to any website, including art-related websites where it is not prohibited by the site’s policy. The reposted product MUST contain the Artist’s signature/watermark and a link to any of the Artist’s online galleries or to this website (https://riesa.carrd.co).
Use the product by any means agreed upon between the Client and the Artist
Resell the product for its original price without VAT (25,5 % of the full price) or lower.
The client may not
Claim the product as their own work
Redistribute the product in commercial means or resell it for reproduction unless agreed upon
Resell the product for a higher price than it was bought for.
2.3.    Intellectual Property
By agreeing with the artist’s Terms Of Services, the Client vouches for having the full copyright over the commissioned IP, or has otherwise obtained rights to use the IP in the commission.
The Artist will not be held responsible in case of copyright breach or misunderstanding regarding the content of the commissioned product.
By agreeing with the Artist’s Terms Of Services, the Client acknowledges this and will be held responsible in case the supposed holder of original copyrights contacts the Artist about the commissioned product and its IP.


3     Payment, Plans, and Refunds
3.1.    Invoicing
Every payment will be made via Ukko.fi invoicing services.
The following information is necessary for the invoice:
Client's email address
Client's first and last name
Client's address
ZIP Code
Country
‼️ The information provided by the Client will be used only for filing taxes ‼️
The Client should provide the information above only when asked for the invoice.
If the Client is a company, the company's name and business identity code are also needed for the invoice.The Client may not send any payments until they’ve received an invoice for their order. The invoice usually takes up to two business days to arrive and will be sent via email.For orders with a total price of 100 € or under, a full payment after the Client's approval of the initial sketch is required.3.2.    Payment Plans
Payment plans can be discussed for orders with a total price of over 100 €.
Each installment of the payment plan will be sent as a separate invoice at the time agreed upon by the Artist and the Client.
3.3.    Refunds
The Client may request a refund for the product only if any of the following conditions is filled:
The production hasn’t yet passed the sketch state.The Artist hasn’t started the production within two months from payment.The Client sent the payment upfront without an invoice or the Artist’s confirmation, AND the Artist hasn't started the production yet.The Artist doesn’t follow the written terms agreed upon.A full refund is possible if the production has not been started yet. After the sketch, the Artist retains the rights to refund only 90—25 % of the payment, depending on the time spent and amount of work put on the production.
